The Trump EPA released a flurry of external and internal guidance in late 2017 and early 2018 that sets the course for the next 12 to 24 months of regulatory and rulemaking activity.  On this Legal Quick Hit, David Friedland of Beveridge & Diamond’s Air Group will provide quick updates on these developments and how in-house counsel should position themselves.  Topics covered will include approaches to New Source Review, MACT applicability, and Risk and Technology Reviews; the impact of a new tax law provision on consent decree negotiations; responding to Section 114 requests for information; limitations on the use of agency guidance; the end of “sue and settle”; and emphasis on federal-state cooperation.  David will cover the material at an intermediate to advanced level (i.e., assuming substantial familiarity with the U.S. Clean Air Act).  This program will be most applicable to a wide range of companies across American industry who have to comply with the Clean Air Act and state air regulations.
