While the Trump Administration says it will withdraw the United States from the Paris climate accord, several state governments, cities, and municipalities have doubled down on their own policies to encourage the development of new clean generation. The line between the federal government’s authority to regulate the wholesale electricity market and the state governments’ authority over its generation sources is a hazy one. Today’s Legal Quick Hit will explain where the Supreme Court has landed on this issue, what avenues states are pursuing in promoting clean generation, and the legal challenges the states are facing along the way.
