In a time of regulatory uncertainty and upheaval, it is important to understand the various ways to address adverse decisions by the federal government. The Administrative Procedure Act (APA), which sets forth requirements for federal agencies in rulemakings, administrative appeals, and other agency proceedings, is important to understand for those initiating and trying to effect regulatory change across all federal agencies. The statute governs judicial review of unfavorable regulations and other agency actions, and APA- litigation is a potentially valuable route for advancing regulatory-related business objectives.
