Employee drug testing policies have always been governed primarily by state law, making multi-state compliance a challenge. Now, more than 15 states have active "medical marijuana" programs, Washington and Colorado have enacted legislation that will legalize marijuana for adult recreational use, and additional states are considering similar legislation. At the same time, employers are increasingly required to assure their customers that their employees are drug-free, and state tort law may punish an employer who knowingly employs drug abusers. What's an employer to do? This presentation will alert you to the evolving laws in this area and provide strategies for ensuring compliance while balancing business imperatives for a drug-free workplace.
